General conditions Los-Olivos, Partida Lleus 9D, 03720 Benissa

General
These are the terms and conditions belonging to the lease agreement between the owner and the tenant. The owner is also referred to hereinafter as "we" and "us".

The renter is the person who signs the booking form or, in the case of online booking, the person who handles the online payment. This person is responsible for ensuring that all members belonging to the group comply with these terms and conditions. The renter is also referred to as "you".

The location referred to here is Los-Olivos, Partida del Lleus 9D, 03720 Benissa

Bookings
The deposit regarding a booking must be paid within 7 days from the provisional booking in the manner indicated by the landlord. The booking is initially a provisional reservation of 1 or more apartments until the deposit has been paid and confirmed by us. Until then, the booking can be cancelled at any time by tenant or owner without prior notice.

The rental amount, together with the deposit of €250, is due no later than 8 weeks before the start of the vacation. Failure to pay this in full before/on the due date means cancellation of the tenant's vacation without the right to a refund of the deposit. So please schedule this due date(s) to ensure that payment is taken care of in a timely manner.

Bookings less than 8 weeks before the arrival date must be paid in full immediately at the time of booking.

Cancellation by tenant
Cancellation of the booking by the tenant must be made in writing and addressed to info@los-olivos.com.

Costs to the tenant due to cancellation:

  • from 8 weeks before arrival 25% of the rental price
  • from 4 weeks before arrival 50% of the rent
  • from 2 weeks before arrival 100% of the rent

Ask for confirmation if you want to inform your cancellation insurance company.

Cancellation by the owner
The owner will endeavor to ensure that the rented property is available on the date reserved. In the unlikely event that the rental is not available, the owner has the right to cancel the reservation. The owner will attempt to find suitable alternative accommodation for the renter. If suitable alternative accommodation is not found, the renter is entitled to a full refund of the rental price. The owner is only obliged to refund the money received from the renter. No compensation or consequential damages will be refunded.

Cancellation due to Covid-19
When travel between the country of origin and Los-Olivos is made impossible by a general travel ban (code red), cancellation or rescheduling is possible free of charge. This expressly does not cover personal circumstances, such as, for example, a positive Covid test or quarantine obligation due to infection. 

Miscellaneous
Although care has been taken to provide a true and accurate description of the leased property, changes may have been made to the leased property over time. The tenant accepts that no compensation will be paid for such differences.

The owner reserves the right to enter the leased premises at a reasonable time, in case of an emergency, repair or other urgent reason, if possible in consultation with the tenant.

The owner has the right to ask the tenant to leave the rented property without any refund if the behavior of the tenant and/or his/her group is disruptive and/or unacceptable according to standards of reasonableness and fairness.

The owner reserves the right to refuse entry to anyone deemed unfit to occupy the rented property.

Number of guests
The maximum number of people entitled to stay in this property is as stated and confirmed in the reservation. Furthermore, only those with the name listed are entitled to stay. If it appears that more persons than agreed upon are staying in and around the rented property without the written consent of the owner, this will be considered a breach of contract and the tenant and his/her party will be asked to leave the property immediately without any refund of rent or other compensation. Subletting or transfer of the rental agreement is prohibited.

If, only after consultation and approval by the owner, a higher number of guests is admitted than agreed / allowed per apartment, the fee is at least € 20, - per night with a minimum of 3 nights.

Parking
One parking space is available on the premises for each apartment. Parking is allowed only in the spaces designated by owner.

Pets
Pets are not allowed in the leased premises.

Arrival and departure time
Every effort will be made to have the property available from 4 p.m. on the day of arrival. The property must be vacated by the tenant no later than 10:00 a.m. on the day of departure. Late delivery will result in a surcharge, unless other arrangements have been made. It is possible by arrangement to store luggage in a locked room if your arrival is earlier than 4 p.m. or departure later than 10 a.m. The owner is present in person, or will be represented, for handing over keys etc.

Liability
The owner is not liable for any accident, theft, loss or damage on his property. Always properly lock your apartment(s) and car(s).

Minor children should always be supervised.

Cleaning
We assume that the tenant and his group will treat the rented property as their own and leave it in a normal condition at the end of the vacation. The cost of final cleaning (€70 for apartments I and II and €100 for apartment III) is included in the rental price, but only for normal cleaning. The owner reserves the right to charge an additional cleaning fee if the property is not left in a normal condition.

Breakage
The renter will make every effort to maintain the home, inventory and all contents in the same condition and condition as at the beginning of the rental. Damage or breakage must be reported to the owner (or his representative) prior to departure. The owner reserves the right to seek compensation for this, noting that minor breakage and normal wear and tear will not be charged.

Complaints
We obviously strive to make your stay with us comfortable and memorable. Things can go wrong. In these circumstances, it is the responsibility of the tenant to report any problem to the owner (or his representative). Only then is it possible for the owner to attempt to rectify/correct the situation as quickly as possible.

Additional costs
The use of electricity (including hot/cold air conditioning) is included in the rental price unless otherwise agreed. This includes rental in the months of November, December, January, February and March. 

Deposit Refund
Your deposit, less any deductions, will be refunded to you within 7 days of departure.

Long-term rental/overwinterers
For long-term rentals and/or in the case of winterers, other arrangements may be/were made between the parties.
